TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern the use of the website and services provided by Takeover Home Service (“we,” “us,” or “our”).

 

By accessing our website, requesting an estimate, or hiring us to perform services, you agree to these Terms.

 

 

1. Services

 

Takeover Home Service provides general handyman and home maintenance services. Services may include repairs, installations, maintenance, and related work. All services, pricing, and timelines are based on the agreed scope of work.

 

 

2. Estimates and Scope of Work

    •    Estimates are based on the information available at the time and are subject to change if the scope of work changes or additional services are requested.

    •    Any changes to the scope of work, materials, or timeline must be approved in writing by both parties before the additional work is performed.

 

 

3. Deposits, Materials, and Payments

    •    A non-refundable deposit equal to fifty percent (50%) of the total agreed-upon job price is required before work begins, unless otherwise agreed in writing. This deposit secures scheduling and covers preparation, administrative time, and reserved labor.

    •    All materials required for the project must be paid in full before work begins, unless otherwise agreed in writing. Materials may include supplies, fixtures, specialty items, or custom-ordered products.

    •    The remaining balance for labor and services is due immediately upon completion of the work, unless alternative payment terms have been agreed to in writing.

    •    We reserve the right to delay, suspend, or stop work until all required payments have been received.

 

 

4. Late Payments

    •    Any balance not paid when due will be considered past due.

    •    Past-due balances may be subject to a late fee of up to one and one-half percent (1.5%) per month, or the maximum amount permitted by Virginia law, calculated from the original due date.

    •    The customer agrees to be responsible for all reasonable costs of collection, including administrative fees, attorney’s fees, and court costs, to the extent permitted by law.

 

 

5. Cancellations and Rescheduling

    •    Customers are asked to provide reasonable notice for cancellations or rescheduling.

    •    Deposits are non-refundable, including cancellations made by the customer after scheduling.

    •    If materials have already been purchased, the customer is responsible for the full cost of those materials.

 

 

6. Customer Responsibilities

 

The customer agrees to:

    •    Provide accurate and complete information

    •    Ensure safe, reasonable, and unobstructed access to the work area

    •    Disclose known issues, hazards, or prior repairs before work begins

 

We are not responsible for delays or issues caused by inaccurate or incomplete information.

 

 

7. Delays and Unforeseen Conditions

    •    We are not responsible for delays caused by factors beyond our control, including weather, material availability, supply chain issues, hidden structural conditions, or acts of God.

    •    Discovery of unforeseen conditions may require changes to pricing or timelines, which will be discussed and approved before proceeding.

 

 

8. Property Condition and Liability

    •    The customer acknowledges that older homes or previously repaired areas may contain hidden defects.

    •    Takeover Home Service is not responsible for pre-existing conditions or damage resulting from latent or concealed defects that could not reasonably be identified prior to beginning work.

 

 

9. Materials and Warranties

    •    Materials are subject only to the manufacturer’s warranties, if any.

    •    We do not provide additional warranties on materials beyond those offered by the manufacturer.

    •    Labor is performed in a professional and workmanlike manner consistent with industry standards.

 

 

10. Worksite Safety and Right to Stop Work

    •    Customers must provide a safe working environment.

    •    We reserve the right to stop or refuse work if unsafe or hazardous conditions exist, required payments are not made, or abusive or threatening behavior occurs.

 

 

11. Permits and Compliance

    •    Where required by law, permits will be obtained as agreed upon in writing.

    •    The customer acknowledges that certain handyman services may not require permits under Virginia law.

 

 

12. Limitation of Liability

 

To the fullest extent permitted by law, Takeover Home Service shall not be liable for:

    •    Indirect, incidental, or consequential damages

    •    Any damages exceeding the total amount paid for the services provided

 

 

13. Intellectual Property

 

All website content, including text, logos, graphics, and images, is the property of Takeover Home Service and may not be used without written permission.

 

 

14. Governing Law and Venue

 

These Terms shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia. Any legal action shall be brought in a court of competent jurisdiction within Virginia.

 

 

15. Severability

 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

 

16. Changes to These Terms

 

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date.
